MEMBER is entirely responsible for
maintaining the confidentiality of its password and account. Furthermore, MEMBER is
entirely responsible for any and all activities that occur under its account.
MEMBER agree to notify WebCab.de immediately of any unauthorized use of its account
or any other breach of security.
It is WebCab.de's policy to respect the privacy of its members. WebCab.de will not monitor, edit, or disclose any personal information about MEMBER or MEMBER's use of the services, including its contents, without MEMBER's prior permission unless WebCab.de has a good faith belief that such action is necessary to: a) conform to legal requirements or comply with legal process; b) protect and defend the rights or property of WebCab.de; c) enforce the ToS; or d) act to protect the interests of its members or others.
WebCab.de makes no guarantee as to the availability of the services.
MEMBER understands that the Internet
and other various networking communication mediums are not secure, unless explicitly
specified as such, and may be subject to interception or loss. WebCab.de makes no
warranties of any kind, either express, implied, or statutory concerning the data or
information available through the WebCab.de server. IN NO EVENT WILL WebCab.de BE LIABLE
TO MEMBER FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE
SERVICES OR ANY PRODUCTS PROVIDED UNDER THIS AGREEMENT, EVEN IF WebCab.de HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION
OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION
MAY NOT APPLY TO MEMBER. WebCab.de's liability to MEMBER for actual damages for any cause
whatsoever, regardless of the form of the action will be strictly limited to a maximum of
0 EUR.
WebCab.de, ITS OFFICERS, DIRECTORS, OWNERS, AGENTS AND EMPLOYEES, SHALL NOT BE LIABLE TO
MEMBER OR ANYONE ELSE FOR ANY LOSS OR INJURY RESULTING FROM USE OF WebCab.de, CAUSED IN
WHOLE OR IN PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING,
COMPILING, INTERPRETING, REPORTING, MAINTAINING OR DELIVERING WebCab.de AND ANY CONTENT
FOUND ON WebCab.de-HOSTED services. IN NO EVENT WILL WebCab.de, ITS OFFICERS, DIRECTORS,
OWNERS, AGENTS AND EMPLOYEES, BE LIABLE TO MEMBER OR ANYONE ELSE FOR ANY DECISION MADE OR
ACTION TAKEN BY MEMBER IN RELIANCE ON SUCH CONTENT. WebCab.de, ITS OFFICERS, DIRECTORS,
OWNERS, AGENTS AND EMPLOYEES, SHALL NOT BE LIABLE TO MEMBER OR ANYONE ELSE FOR ANY DIRECT,
CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE WebCab.de.
WebCab.de services may only be used
for lawful purposes. Transmission or solicitation of any material that violates German or
other laws that may apply in this jurisdiction or MEMBER's local area is prohibited. This
may include material that is obscene, threatening, harassing, libelous, or in any way a
violation of intellectual property laws.
MEMBER agrees to use the WebCab.de account
in a way that conforms with all applicable laws
and regulations. MEMBER specifically agrees not to make any attempt to gain unauthorized
access to any systems or networks connected to WebCab.de either within or outside or under
the direct control of WebCab.de's server.
WebCab.de reserves the
right to modify this agreement at any time, with or without notice,
at WebCab.de's sole discretion.
